Murder Palace

Murder Palace is a creative agency run by Rey Gutierrez.

These Terms of Service ("Terms") apply to murderpalace.com, aoos.app and every website, channel, page, post and service operated by Murder Palace (together, the "Sites"). By using the Sites you agree to these Terms. If you do not agree, please do not use the Sites.

What we are

Murder Palace is a creative agency and independent studio, and the owner of the Murder Palace name and trademark. It is the parent of every channel published on the Sites and of ALPHA OMEGA, the studio software Murder Palace uses to make its work. In these Terms, "Murder Palace", "we", "us" and "our" mean Murder Palace, the company, and its founder.

What we do

  • Channels. We publish a family of channels, including Murder Palace, Suicide Miami, My Cosplay Life, Lion From Mars, PlayStation Lab, Nintendo Pro, Xbox Love, PC Automatica and The Grid, each on its own site or page.
  • Original work, much of it made with AI. The stories, characters, images, music, video and writing on the Sites are original creative work. Much of it is created with the help of artificial intelligence tools, then directed, selected and edited by people.
  • Digital actors. The people who appear in our stories, films and posts are digital actors: fictional characters created by Murder Palace. They are not real people, and any resemblance to a real person is unintended unless the work is clearly labelled as commentary about a public figure.
  • Satire and commentary. Some channels, such as Xbox Love, and the characters that comment on public figures, are parody, satire and commentary. That content is AI-generated. It does not show or speak for the real people, companies or products it refers to.
  • Bookings and commissions. We take bookings (including DJ performances) and creative commissions for brands, casts and channels, arranged through our booking link or by email.

No affiliation or endorsement

Murder Palace is independent. We are not affiliated with, sponsored by or endorsed by Microsoft or Xbox, Sony or PlayStation, Nintendo, or any other company, brand or person named or referenced on the Sites. All third-party names, titles, logos and trademarks belong to their respective owners and are used only to identify the subject being discussed, for commentary, criticism, news reporting or parody.

No voice cloning of real people

We do not clone or imitate the voices of real people. Voices on the Sites belong to fictional digital actors or are used with permission. We will not accept a commission that asks us to reproduce a real person's voice or likeness without that person's written consent.

Intellectual property

Unless stated otherwise, everything on the Sites, including characters, worlds, stories, music, images, video, text, logos and designs, is owned by Murder Palace and protected by copyright, trademark and other laws. You may view and share links to the Sites for personal, non-commercial use. You may not copy, republish, sell, train software on, or create derivative works from our content without our written permission. Murder Palace, ALPHA OMEGA and our channel names and logos are our trademarks.

Acceptable use

When using the Sites you agree not to:

  • break any law or anyone else's rights;
  • copy, scrape or harvest content or data at scale, including for training software;
  • try to gain unauthorized access to the Sites, our systems or other users' information;
  • upload or send anything harmful, such as malware, spam or content that is unlawful, harassing or hateful;
  • present our characters, content or trademarks as your own, or suggest that we endorse you;
  • interfere with the normal working of the Sites.

We may restrict or end access for anyone who breaks these rules.

Submissions, contact forms and bookings

When you send us a message, join a mailing list, submit a form or book a call, you agree that the information you give is accurate and that you have the right to share it. We use it to reply, to arrange the booking or commission you asked about, and, if you opted in, to send you news. We do not sell your personal information. Please do not send us ideas, scripts or creative material you want to keep confidential: unsolicited submissions are not treated as confidential, and we are free to develop similar work independently. Commissions and paid bookings are governed by a separate written agreement, which takes priority over these Terms where the two differ.

Mature content and age notice

Some channels contain mature themes, including horror, violence, dark humour and suggestive content. The Sites are intended for adults aged 18 and over. Where a channel carries mature content, it may ask you to confirm your age. If you are under 18, please do not use those channels.

The Sites link to other websites and use third-party services, such as booking, analytics, payment and social platforms. We do not control those services and are not responsible for their content or practices. Their own terms and privacy policies apply.

Disclaimers

The Sites and their content are provided "as is" and "as available". Content is for entertainment and information only. We do not promise that the Sites will always be available, error-free or secure, and we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement, to the extent the law allows.

Limitation of liability

To the fullest extent permitted by law, Murder Palace and its founder, team and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Sites. Our total liability for any claim relating to the Sites is limited to the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars (US$100).

Indemnity

You agree to defend and hold harmless Murder Palace from claims, damages and costs arising from your misuse of the Sites or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida, and you agree to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows when they last changed. If you keep using the Sites after a change, you accept the updated Terms.
